These Terms of Use constitute a legally binding agreement between you (whether personally or on behalf of an entity) and Pure Purpose, LLC (doing business as "MIS-Fit," referred to as "Company," "we," "us," or "our"), concerning your access to and use of the mis-fit.io website and any related media, channels, or applications (collectively, the "Site").

By accessing the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must discontinue use of the Site immediately.
We reserve the right to modify these Terms at any time. Changes will be indicated by an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

When you complete the Smart Systems Fit Check™ or any other assessment tool on the Site, you understand that:
The Site may contain links to third-party websites or content. We do not investigate, monitor, or verify the accuracy or appropriateness of third-party content. We are not responsible for any third-party websites accessed through the Site, including their content, privacy practices, or policies. Accessing third-party websites is at your own risk.
We reserve the right to: (1) monitor the Site for violations of these Terms; (2) take appropriate legal action against violators; (3) refuse, restrict, or limit access to the Site at our sole discretion; and (4) manage the Site in a manner designed to protect our rights and property and to facilitate proper functioning.
We care about your data privacy and security. Please review our Privacy Policy, which is incorporated into these Terms of Use. By using the Site, you agree to be bound by our Privacy Policy.
The Site is hosted in the United States. If you access the Site from another jurisdiction, you consent to the transfer and processing of your data in the United States.
You agree to defend, indemnify, and hold us harmless — including our subsidiaries, affiliates, officers, agents, partners, and employees — from any loss, damage, liability, claim, or demand (including reasonable attorneys' fees) arising from: (1) your use of the Site; (2) breach of these Terms; (3) breach of your representations and warranties; (4) your violation of third-party rights; or (5) any harmful act toward another user of the Site.
These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
The parties agree to first attempt to resolve any dispute informally for at least thirty (30) days before initiating arbitration. Informal negotiations commence upon written notice from one party to the other.
If informal negotiations fail, disputes will be resolved through binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Arbitration will take place in San Joaquin County, California. You understand that by agreeing to arbitration, you waive your right to a jury trial.
Any arbitration shall be limited to the dispute between the individual parties. No arbitration shall be joined with other proceedings, conducted on a class-action basis, or brought in a representative capacity.
The following disputes are excluded from the arbitration requirement: (a) disputes concerning intellectual property rights; (b) disputes related to theft, piracy, invasion of privacy, or unauthorized use; and (c) claims for injunctive relief.
These Terms remain in effect while you use the Site. We reserve the right to deny access to the Site to any person for any reason, without notice or liability, including for breach of these Terms or applicable law.
We reserve the right to change, modify, or remove Site content at any time without notice. We cannot guarantee uninterrupted availability and will not be liable for any downtime, interruption, or discontinuance.
By visiting the Site, sending emails, or completing online forms, you consent to receive electronic communications. You agree that electronic communications satisfy any legal requirement for written communication.

These Terms of Use constitute the entire agreement between you and us regarding the Site. Our failure to exercise any right or provision shall not operate as a waiver. If any provision is determined to be unlawful or unenforceable, it shall be severed without affecting the remaining provisions. No joint venture, partnership, employment, or agency relationship is created by these Terms. No dispute may be commenced more than one (1) year after the cause of action arose.
